The boundary of the subzone area designated on the attached map is identified as the Kilauea Lower East Rift (Kapoho Section) Geothermal Resource Subzone. The subzone area includes geothermal resource mining leases - GRML R-2, GRML R-3, and S-4602, and contains approximately 7,353 acres, more or less, and is located west of Leilani Estates and extends eastward to Cape Kumukahi.

<description>The Department of Health, in accordance with the requirements of Chapter 91 , Hawaii Revised Statutes (HRS), amended and compiled Chapters 11-59 and 11-60, Hawaii Administrative Rules (HAR). These rules, among other things, amended the State's air quality rules, and became effective on June 29, 1992. Special condition number 1 of Authority to Construct (ATC) No. A-833-795 specifically notes that the ATC may be revised to conform to the State's air quality rules. Pursuant to special condition number 1 (as well as Chapter 3429, HRS, and Chapters 11-59 and 11-60, HAR), the Department of Health has consolidated the prior permit changes and made additional minor revisions to A TC No. A-833-795 to conform to our most recent amendments to the State's air quality rules. Enclosed with the letter are attachments I and IL The conditions set forth in Attachments I and II supersede in their entirety the conditions issued with ATC No. A-833-795 dated February 6, 1990, and as modified on March 16, 1990, May 28, 1991, and January 13, 1992. These modifications shall become final twenty (20) days after receipt, unless before the twenty (20) days expire, Puna Geothermal Venture submits a written statement to the Director of Health either waiving its right to a hearing or requesting a hearing pursuant to Chapter 91 and Chapter 3429, HRS. If a hearing is requested, it will be held at a date, time, and place to be specified later and conducted in accordance with Chapter 91, HRS, and the Rules of Practice and
Procedure of the Department of Health.

<description>Memorandum from Manubu Tagomori, Deputy Director to William Paty, Chairperson regarding Calculation of Geothermal Royalty. DLNR Administrative Rule section 13-183-31 (a) provides that "The rate of the royalty to be paid to the State for the production of geothermal resources shall be determined by the board prior to the bidding for or granting of a mining lease, but the rate shall not be less than ten percent nor more than twenty percent of the gross amount or value of the geothermal resources produced under the lease as measured at the wellhead and sold or utilized by the lessee." Section 13-183-31 (b) also states that "For the purpose of computing royalties, the amount or value of geothermal resources produced shall be determined as the gross proceeds received by the mining lessee from the sale or use of geothermal resources produced from the leased land as measured at the wellhead. In the event that geothermal production hereunder is not sold to a third party but used or furnished to a plant owned or controlled by the lessee, the gross proceeds of the production for purposes of computing royalties shall be that which is reasonably equal to the gross proceeds being paid to other geothermal producers for geothermal resources of like quality and quantity under similar conditions after deducting any and all treating, processing, and transportation costs incurred."  Ideally, in a situation where steam is sold to a third-party under an "arms-length sale", gross proceeds are computed as follows: Gross Proceeds = (total pounds of steam produced and measured at the wellhead) X (unit value of steam, $/lb). However, the current situation in Hawaii is different from that described above and the calculation of gross proceeds as provided by section 13-183-31(b) for a no-sales or non arms-length arrangement should be as follows: in the event that steam is not sold to a third party and is used by a plant owned or controlled by the lessee, the gross steam proceeds, for purposes of computing royalties, shall be determined by measuring the steam (lb/hr) used by the lessee's facility and multiplying that amount by the steam unit value ($/lb) utilized by other similar geothermal steam producers. A problem arises, however, that although an equivalent unit value of steam ($/lb) equal to that paid to other producers/suppliers of steam of like quality and quantity could be used to calculate gross proceeds, no such "standard" unit value of steam is available for computing gross proceeds. Puna Geothermal Venture's (PGV) geothermal resource mining lease R-2, Section 5, provides that the State shall receive a "royalty of ten (10%) percent of the gross proceeds received by the
Lessee from the sale or use of geothermal resources produced from the leased lands and measured at the wellhead without any deduction for treating, processing and transportation cost, notwithstanding Rule 3.13 b. of Regulation 8" (now identified as Sect. 13-183-31 (b». It should be noted that contrary to the regulation, mining leases R-1, R-2, R-3, and R-4 have language which disallows the deduction of those costs allowed in section 13-183-31(b). Only lease R-5 has language contained therein which allows the deduction of any treating, processing and transportation costs incurred. Notwithstanding any conflict between the regulation and the leases, the PGV 25 MW project is a typical case where the lessee both produces the geothermal resource and utilizes it in its own power plant to generate electricity. In this situation, the electrical energy is sold, and not the geothermal resource (steam). The resultant gross revenue is a function of the sale of electricity generated rather than from the sale or use of steam. Therefore, there is no steam sales transaction by which to measure the value of the geothermal resource and an alternative method must be selected in which to calculate the value of the geothermal resources produced.

<description>If the geothermal resource on the Big Island of Hawaii is developed as planned, the Wao Kele '0 Puna rainforest will be destroyed, seriously damaging U.S. credibility in its efforts to halt rainforest destruction worldwide. It would be tragic for this to happen, since on a least-cost basis, the geothermal project does not make economic sense. Improving energy efficiency in Hawaii over the next ten years can reduce electricity demand by almost 50% at an average cost of less than 4 kWh. This is almost 5 times less than the estimated 30-year levelized cost of providing power from the proposed geothermal project and accompanying undersea cable. The "bottom line" is that the geothermal project is risky, very expensive to build and maintain, and comes with no guarantees. On the other hand, a state-wide energy efficiency program using proven technology, will free up more power than the geothermal project could ever provide, will save Hawaiian ratepayers hundreds of millions of dollars, and will buy precious time to develop solar and wind power over the next 10-20 years. The choice is simple, but political and legislative action is required. Hawaii must move forward and develop a least-cost electricity planning process to ensure that all available options for meeting new electricity demand are assessed before investing in new supply. Utility profit-making rules have to be rewritten to reward utilities for investing inthe energy efficiency of their customers, and building energy standards must be implemented and enforced. If new sources of electricity supply are required, then state energy planners must make every effort to develop solar and wind power, and improve the efficiency of electricity generation from sugar cane bagasse, since all of these technologies are currently cheaper than geothermal power. All available resource options must be seriously evaluated on an economic basis before plans for the geothermal project go any further.
