Letter to the Secretary of War from Attorney General Biddle about a pardon of a civilian by General Richardson as the Military Governor of the Territory of Hawaii, questioning such a power to pardon and suggesting voluntary adjustment by the War Department of the matter of military governor. Attached is a copy of the subject pardon by General Richardson, the Military Governor of the Territory of Hawaii; a reply letter to Secretary of the Interior Ickes from Assistant Secretary of War John J. McCloy regarding this pardon and stating that the Judge Advocate General of the War Department held that the pardon is without legal validity; a memorandum for the Assistant Secretary of War from the Judge Advocate General, stating this legal opinion regarding the pardon; a letter to Assistant Secretary of War John J. McCloy from Secretary of the Interior Ickes enclosing a copy of the opinion on the pardon by the Solicitor of the Department of the Interior with the Solicitor's opinion copy and a copy of a letter from Territory of Hawaii Governor Stainback to the Secretary of the Interior informing him of the pardon by General Richardson; an earlier letter to Assistant Secretary of War John J. McCloy from Secretary of the Interior Ickes urging the Army to take action about the "Military Governor of the Territory of Hawaii;" and a memorandum for the Judge Advocate General from the Executive to the Assistant Secretary of War requesting an opinion on the validity of the pardon.
